Like all of our AI-powered features, we’ve put dedicated effort into developing AI-Assisted Application Review thoughtfully and in alignment with our Pillars of Responsible AI.

Privacy

Ashby does not train any AI models on customer data. PII (personally identifiable information) is redacted from all resumes sent to AI models.

Transparency & Bias

Ashby gives you citations for all AI outputs, so you can verify, flag and override analyses if needed. Ashby also provides in-app warnings for criteria that can lead to biases in application review. The AI never ‘ranks’ or gives numerical ratings to applicants, a human must always be involved in decision-making.

Accountability

Ashby provides automated candidate disclosures and opt-outs. Ashby has also partnered with the third party auditor FairNow to conduct a bias audit of any screening functionality with regards to members of protected classes. FairNow also helps to maintain a model inventory and support risk assessments in anticipation of compliance requirements related to the EU AI Act and other legislation at the state level in the US.

We believe in the power of AI to make the entire recruiting process better; we’ve taken steps to make sure that we implement AI responsibly, based on 5 core pillars.

Accountability

We build AI features with clear governance in place. That includes internal oversight, risk assessments, and working with third-party experts like FairNow to audit our systems. We define clear ownership across Engineering, Legal, and Product for every AI initiative, from evaluation and testing to post-launch performance and risk monitoring.

Transparency

Ashby does not ship or buy products with black-box decision-making. Any AI-generated recommendation must be explainable, either by exposing the reasoning behind it or enabling user review and override. For example, our application review tool shows why a candidate is surfaced and links directly to the evidence behind it. AI-generated tokens always allow the user to review and override.

Fairness

We regularly evaluate and audit our models for fairness, ensure reputable third parties assist with the audit of AI systems we use (FairNow in the case of Ashby), and test outputs (e.g., job descriptions, summaries, outreach) for clarity and inclusion across diverse audiences. We’ve also built several features into the product to help protect against bias, both implicit and explicit. These include in-app warnings about specificity and best practices for prompting AI-Assisted Application Review and more direct warnings about potential Equal Employment Opportunity (EEO) violations.

Safety

Our AI systems are designed to operate within clear, tested boundaries. We monitor performance in production, check for predictable failure modes, and have response plans ready if something doesn’t work as expected. We log model performance, user feedback, and feature usage across the system. This allows us to audit how AI is working and intervene quickly if something goes wrong. We’ve implemented real-time monitoring, direct user feedback tools, and periodic reviews of flagged outputs.

Privacy & Security

We do not train AI models on customer data and operate on the principle of data minimization. All candidate information is handled in compliance with GDPR, NY Local Law 144, and SOC 2 standards. Encryption and retention settings must be configurable by our team. Privacy and compliance are built into every part of our AI development process, not retrofitted later.

FAQs about AI Functionality in Ashby

As a guiding principle, AI is used to augment, and not replace human decision-making within Ashby. We've dedicated resources toward developing AI responsibly and ethically, and are happy to provide documentation needed for your legal team.

Is customer data used in training AI models?

Ashby is not currently training any AI models using customer data. We are using third party AI models (e.g. OpenAI) within the scope of our AI terms and conditions. We have a DPA in place with OpenAI such that no data sent as part of our use of OpenAI's models is used to train their own models.

What risk management and risk mitigation measures does Ashby have in place?

As part of our efforts to maintain good AI governance, we have engaged FairNow to help maintain a model inventory and support risk assessments in anticipation of compliance requirements related to the EU AI Act and other legislation at the state level in the US (e.g. NY Local Law 144, Colorado SB 24-205).

Is Ashby compliant with the EU AI Act?

Ashby has chosen to take a proactive approach in beginning to meet its compliance objectives under The Act.

Per Article 113 of the EU AI Act, (and given the scope of Ashby’s product) enforcement of The Act comes into play August 2, 2026

Does Ashby disclose the nature of data processing to applicants during the recruitment process?

Yes. We provide your team with controls on how you disclose your use of AI during the recruitment process. Candidates have the ability to opt-out.

. Important to note that as a 'Deployer' under the AI Act and 'Data Controller' under GDPR, this is the responsibility of customers to enable based on their own policies and language.

Is Ashby NY Local Law 144-compliant?

Ashby has conducted a bias audit compliant with the law’s requirements and built tooling to support candidate notification / opt-out. While Ashby does not consider the currently provided tooling to qualify as an Automated Employment Decision Tool (“AEDT”) under the definition provided in Section 5-300 of the law, we still conducted this audit to support customers with differing interpretations.

Are Ashby's AI features compliant with GDPR?

Yes - all of Ashby's products (including these features) are GDPR compliant. To further reinforce Ashby's commitment, we recently certified to the Data Privacy Framework (DPF), including the EU-U.S. Data Privacy Framework, the Swiss-U.S. Data Privacy Framework, and the UK Extension to the EU-U.S. Data Privacy Framework.
